Terms of Service
These terms govern use of the Orbyts platform provided by Orbyts Group Pty Ltd (ABN 90 699 748 386) (“Orbyts”, “we”, “us”). Where a customer has signed a separate written agreement with us, that agreement prevails over these terms to the extent of any inconsistency.
Accounts
Access is granted to an organisation, which is responsible for the accounts it creates and for the actions taken under them. Users must keep their credentials confidential and tell us promptly if they believe an account has been compromised.
Customer data
Customers retain ownership of the data they put into Orbyts. We use it only to provide and support the service, as described in our privacy policy. Customers are responsible for the accuracy of the records they enter and for having a lawful basis to hold information about their staff and candidates.
Acceptable use
Customers and users must not:
- use the platform unlawfully, or to store or transmit unlawful material;
- attempt to gain unauthorised access to the platform or to another organisation's data;
- interfere with the platform's operation, security or availability; or
- use the platform to send unsolicited bulk messages.
Service messages
Some messages are part of the service and cannot be switched off — password resets, security alerts and similar notices. Turning them off would prevent people from recovering or protecting their own accounts.
Availability
We aim to keep Orbyts available at all times, but we may need to interrupt it for maintenance, and we do not warrant uninterrupted or error-free operation. Where a written agreement specifies service levels, those apply.
Fees
Fees, billing periods and payment terms are set out in the customer's order or written agreement with us.
Suspension and termination
We may suspend access where necessary to protect the platform, our customers, or to comply with law — for example after a serious security incident or unpaid fees. On termination a customer may request an export of their data within a reasonable period, after which we may delete it in line with our retention practices.
Liability
Nothing in these terms excludes rights that cannot lawfully be excluded, including under the Australian Consumer Law. Subject to that, our liability arising out of the service is limited as set out in the customer's written agreement with us.
Changes
We may update these terms from time to time and will change the date at the top. Material changes will be notified to account administrators.
Governing law
These terms are governed by the laws of Western Australia, Australia.
